Terms of Use

This agreement represents the complete agreement and understanding between AKAS Virtual Design (AKAS) and the Customer and supersedes any other written or oral agreement. Upon notice published on-line, AKAS may modify these terms and conditions, amplify them, and/or modify the prices, as well as discontinue or change services offered.

1. AKAS makes no warranties of any kind, whether expressed or implied, for the service it is providing. You agree that your use of our Services is solely at your own risk. You agree that such Service(s) is provided on an "as is," "as available" basis. AKAS also disclaims any warranty of merchantability or fitness for a particular purpose. AKAS will not be responsible for damages the customer suffers. This includes loss of data, non-deliveries, misdeliveries, or service interruptions caused by its own negligence, Customer's errors or omissions, or due to the fault of third parties. We make no warranty that the Services will meet your requirements, or that the Service(s) will be uninterrupted, timely, secure, or error free; nor do we make any warranty as to the results that may be obtained from the use of the Service(s) or as to the accuracy or reliability of any information obtained through the Service or that defects in the Service will be corrected.

2. Services provided to the Customer by AKAS may only be used for lawful purposes. Transmission or publication of any information, data or material in violation of any Canadian or U.S. Federal or state regulation or law is prohibited. This includes, but is not limited to, material protected by copyright, trade secret or any other statute, threatening material or obscene material.

3. Customer agrees to defend, hold harmless and expeditiously indemnify AKAS from any liability, claim, loss, damage or expense arising out of the indemnifying party's breach or violation of any covenant contained in this Policy and resulting from the Customer's use of the service. 

4. Setup fees (for web sites) are not refundable. 

5. AKAS requires that its agreements be made with a person who is qualified to contract. As such, the subscriber must be over the age of eighteen (18) years. Otherwise, a parent or guardian must accept this agreement and enclose the proper payment. AKAS cannot accept payments from persons who are not at least eighteen (18) years of age, nor can we accept agreements from persons who are not at least eighteen (18) years of age. 

6. Use of other organizations' networks or computing resources and electronic money transfer services is subject to their respective permission and usage policies. (see Third Parties Service*)

7. On occasion, AKAS may have a need to communicate with its customers through e-mail regarding issues related to changes, additions and modifications of services. It is the responsibility of the customer to check e-mail sent in the service application.

8. Third Parties Service* - Some features of AKAS website are provided by third parties -- specifically, domain name registration and electronic money transfer services (for example PayPal) -- and require additional registrations with those third parties. In those cases, AKAS may share your registration information with those third parties, but only for the purpose of streamlining your registration. AKAS is not responsible for the privacy practices or content of other sites (Third Parties Service*) or link to from your site. We will not process data about any identified or identifiable natural person that we obtain from you in a way incompatible with the purposes. We will take reasonable precautions to protect the information we obtain from you from loss, misuse, unauthorized access or disclosure, alteration or destruction of that information. 
AKAS holds the highest respect for it's customers and guarantees our firm commitment to your privacy. We do not sell any of the information provided by you to any other institutions.
